Terms & Conditions

1.1. Orders are processed and shipped within up to 3 weeks from the purchase date, unless otherwise specified.

1.2. International delivery is available. Shipping costs and estimated delivery times are calculated at checkout based on destination zone and artwork logistics tier. By purchasing, both you and I agree to these terms.

1.3. Any customs duties, taxes, or additional import costs into the buyer's country are the buyer's sole responsibility.

2.1. All prices are displayed in Canadian Dollars (CAD) and include applicable fees. Prices may also be quoted in USD upon request.

2.2. Accepted payment methods include:

• Credit / debit cards
• Apple Pay
• Google Pay

You agree to provide accurate and complete payment information when placing an order.

2.3. In the case of a pricing error, I reserve the right to cancel or modify your order, or contact you for further instructions.

3.1. If you receive a damaged or defective item, please contact me at daniel.depool@gmail.com within 7 business days of receiving your order, and provide photos or videos of the damaged packaging or artwork.

3.2. In cases of damage or loss during transit, I will issue a refund, replacement, or arrange a return, subject to availability. Refunds are credited within 7 business days after I receive and verify the returned item.

3.3. To qualify for a return or refund:

• The item must be in its original condition and packaging.
• You are responsible for safe return packaging. Inadequate packaging may result in a 50% deduction from the refund.
• Each case is evaluated individually to find the best solution.

3.4. Under Canadian Consumer Protection standards applicable in British Columbia, original handmade paintings are unique, one-of-a-kind works and cannot be returned unless:

• The product was damaged in transit, or
• The delivered item does not match your order.

3.5. Colour differences between digital photographs displayed on this website and the physical painting may occur due to variations in screen types, brightness, contrast settings, and ambient lighting. You are encouraged to request additional photographs or a short video before purchasing. Once payment is made, colour differences alone are not accepted as grounds for a return or refund.

3.6. Complaints must be submitted within 7 days of receiving the order and must include photographic evidence.

3.7. Not liking the product is not a valid reason for a return, given its unique and original artistic nature.

3.8. Return Procedure — If you wish to return an item for a valid reason permitted under these Terms, you must first notify me by email at daniel.depool@gmail.com. Upon approval, I will provide a return label with insurance and the correct return address.

3.9. Any unannounced or unauthorized return, or any manipulation of the artwork without prior notice, will void the possibility of a refund. This policy exists to protect unique original artworks from damage during transit.

• If delivery fails due to the buyer's fault (e.g., incorrect address), the buyer will cover the cost of re-delivery.
• If the error was mine, I will cover the re-delivery costs.
• If the product arrives at a pickup point and is not collected in time, you must arrange repeat delivery. If refused, no refund will be issued.

5.1. All artworks on this website are protected by copyright and intellectual property laws under Canadian law.

5.2. Purchasing an artwork does not grant rights to the image or concept. Reproducing or using any material without prior written permission is strictly prohibited.

6.1. While I strive to provide accurate information, I do not guarantee its completeness or reliability. You use this website at your own risk.

6.2. I am not liable for direct, indirect, incidental, or consequential damages resulting from your use of this website or its products.

7.1. These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein.

7.2. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada. Legal action pursued in another jurisdiction will be at the buyer's expense.

For custom sizes, materials, or special requests, please contact me directly at daniel.depool@gmail.com with your specifications and any image references.

Most custom pieces are completed within 8 weeks, allowing adequate drying time. Additional fees for size and shipping will be discussed individually.

You will receive a completion date and payment instructions upon acceptance. Your order will only be processed after full payment.

If I cannot complete the work on time, you will receive a full refund, or we will agree on revised terms.

Advance deposits are non-refundable if the client's reason for cancellation is not justified or is unrelated to an error made by the artist.

If the artwork is completed and the client fails to pay the remaining balance, the deposit will not be refunded and the order will be considered cancelled.

Final payment must be made before the artwork is shipped.

Unless agreed otherwise, all paintings are unframed, and without hanging devices.
